You are considered unmarried for the whole year if either of the following two applied: (a) you have obtained a final decree of divorce or separate maintenance by the last day of the tax year; or (b) you obtained a decree of annulment.

NEW YORK COURT RULES THAT OPT-OUT OF CSSA CHILD SUPPORT NOT ENFORCEABLE BECAUSE OF PARTIES’ FAILURE TO FOLLOW MANDATORY PROCEDURES

            A substantial percentage of divorcing couples with unemancipated children agree to deviate from the presumptive amount of basic child support that would be payable under the New York State Child Support Standards Act (CSSA).  Typically, such opt out agreements are approved by the courts.  During the past 19 years, I have done hundreds of such opt-out agreements.   I can recall only a single instance when an agreement was questioned by the court - and in that instance, the agreement's child support provisions were ultimately approved.

NO FAULT DIVORCE IN NEW YORK

In 2010, New York joined every other state in the United States by enacting a no-fault basis for divorce.  New York's No Fault Divorce Statute permits any individual wanting a divorce to obtain a divorce judgment by alleging a breakdown of the marriage. The statute describing the new "no-fault" ground for divorce (codified at New York Domestic Relations Law, Section 170(7) permits anyone to allege in their divorce complaint that "The relationship between husband and wife has broken down irretrievably for a period of at least six months".

NEW YORK APPELLATE COURT REVERSES ABSURD FAMILY COURT CHILD SUPPORT ORDER

Many New York divorce lawyers will tell you that in the rough and tumble world of New York courts, the Family Courts are among the roughest.  Unlike the Supreme Courts (equivalent to "superior" courts in other states), which decide divorce cases, the Family Courts are where unmarried (and oftentimes indigent) parents try to get their child support, custody, and other family law disputes resolved.  I use the word "try" because the Family Courts do not always carry out their statutory responsibilities.
